Calculate Your Entitlements and Deadlines
Before filing, estimate your entitlements using the end-of-service benefit calculator and the Article 77 compensation calculator, and confirm the deadline for hearing the claim using the statutory deadlines calculator.
Record the Timeline of the Employment Relationship
Write down the start date of employment, the job title, the wage, and any subsequent changes, then record the events related to the dispute in chronological order. Clarify whether the relationship is ongoing or has ended, and which documents relate to the last working day or the termination notice. Separate the facts you have documents for from those that need clarification.
Gather the Contract and Proof of the Working Relationship
Prepare the employment contract, its annexes, and any available decisions and correspondence related to the matter. Among the requirements of the amicable settlement service, the Ministry of Human Resources and Social Development lists attaching the employment contract, if any, or proof of the contractual relationship; so present what you have even if you do not have a copy of the contract.
Itemize the Financial Claims
List each amount as a separate item, with the period it relates to, how it is calculated, and the supporting document. Attach payslips and transfers, along with any available documents on relevant leave, commissions, or deductions. This table is for preparation and review, and does not by itself establish entitlement to the amounts listed in it.
Attach All Previous Proceedings in Full
If a request was previously filed, a session held, or a record or judgment issued, attach a copy with its number and date. Indicate any upcoming date you are aware of. The Ministry explains that amicable settlement is a first stage for considering disputes between the employee and the employer within the scope of its service; whether the procedure suits the file is reviewed before taking the next step.
Define the Question You Want Answered
Do you need an assessment of entitlements, a response to a claim, a review of a termination procedure, or representation in an existing dispute? State your request clearly and send an initial summary to get in touch. Once the matter is understood, the scope of the review, any additional documents, and the work covered by the engagement are determined.
From Amicable Settlement to the Labor Court
Before reaching the Labor Court, a dispute ordinarily goes through the amicable settlement stage at the Ministry of Human Resources and Social Development. The Ministry describes this service as the first stage for considering a disagreement between an employee and an employer, aimed at narrowing the parties' positions and conducting mediation. Its duration, per the service page, is 21 working days, and it is free of charge.
If settlement is not reached, the request is referred to the competent Labor Court under the procedures adopted by the Ministry of Justice. There are independent labor courts in Riyadh, Makkah, Jeddah, Madinah, Dammam, Buraydah, and Abha, while the labor circuits in the general courts hear cases in other cities and governorates. For details on this stage, read Amicable Settlement of Labor Disputes.
Labor Complaint and Labor Lawsuit: What Is the Difference?
Many people use the phrase labor complaint to describe two different things. The first is a report to the Ministry of a violation of the provisions of the Labor Law, aimed at supervising the business. The second is a claim for a personal right, such as unpaid wages, the end-of-service award, or compensation, whose path is amicable settlement followed by filing a labor lawsuit if settlement is not reached.
A report does not necessarily replace claiming the right itself. Therefore, define precisely what you want: is it to address a violation, to recover an amount, or both? Note that Article 222 of the Labor Law sets the limitation period for hearing a labor claim at twelve months from the date the employment relationship ended, so do not delay your request while waiting on verbal promises.
Common mistakes before filing a labor lawsuit
- Signing a final settlement release or an acknowledgment of receipt before reading its wording and understanding its effect on the remaining entitlements.
- Lumping claims into a single amount without detailing each item, its period, and its method of calculation.
- Errors in the defendant business's details, such as its registered name, registration number, or address.
- Relying on memory for dates instead of documents and messages.
- Failing to keep the amicable settlement record or the request number, even though it is required to follow up on the referral.
- Delaying the request until the limitation period for hearing the claim is nearly over.
To calculate certain claims before submitting them, see How to Calculate the End-of-Service Award.
If you represent the business
The employer's file in a labor dispute is no less important than the employee's file. Gather the employment contract and its addenda, attendance and departure records, proof of wage payment, the approved work organization bylaw, disciplinary decisions and investigation reports if any, the termination decision, and proof it was communicated. If the termination relies on one of the cases under Article 80 of the Labor Law, review evidence that the case and its conditions are met, including giving the employee the opportunity to state reasons for objecting. An early, organized response during the settlement stage helps narrow down the genuine points of dispute.
Frequently asked questions
Can a Labor Lawsuit Be Filed Directly with the Labor Court?
The Ministry of Human Resources and Social Development explains that amicable settlement is the first stage for considering labor disputes falling within the scope of its service. If settlement cannot be reached within its period, the request is referred to the competent Labor Court. Most parties therefore begin by requesting settlement through Wadi before proceeding to litigation.
What Is the Limitation Period for Hearing a Labor Claim?
Article 222 of the Labor Law set the limitation period for hearing a claim relating to rights arising from the law or from the employment contract at twelve months from the date the employment relationship ended. It is therefore advisable to submit the amicable settlement request early and not rely on verbal negotiations to postpone it.
Where Are the Labor Courts Located?
Independent Labor Courts exist in seven cities: Riyadh, Makkah, Jeddah, Madinah, Dammam, Buraydah, and Abha. In other cities and governorates, labor circuits within the General Courts hear these cases. Many procedures can be followed electronically through Najiz.
What Are the Essential Documents for a Labor Complaint File?
The employment contract or whatever establishes the contractual relationship, payroll records and transfers, the termination or resignation decision, correspondence related to the dispute, and a detailed schedule of claims and how each is calculated. Any prior minutes or decision, with its number and date, should be added to these.
